Rightika Copyright & Intellectual Property Policy

1. Introduction

Rightika Inc. ("Rightika") respects the intellectual property rights of others and expects its users to do the same. Our Platform Agreement (Terms of Service) requires that all Content uploaded by Sellers be original, fully owned, or properly licensed.

This policy outlines the procedure for copyright owners to notify Rightika of alleged copyright infringement and the procedure for Sellers to respond to such notices. We comply with the framework of the Digital Millennium Copyright Act (DMCA) and analogous international copyright laws.

2. Prohibition of Infringing Content

You may not upload, list, or distribute any Content on the Rightika Platform that infringes upon the copyright, trademark, or other intellectual property rights of any third party.

If you are a copyright owner (or an agent authorized to act on behalf of one) and you believe that Content on our Platform infringes your copyright, you must submit a formal Takedown Notice.

To be effective, your notice must be a written communication sent to our Designated Copyright Agent (see Section 4) and must include substantially the following:

  1. Identification of the Copyrighted Work: A description of the copyrighted work(s) that you claim have been infringed.
  2. Identification of the Infringing Material: A description of the material you claim is infringing, and information reasonably sufficient to permit us to locate the material on our Platform (e.g., the direct URL to the film's page).
  3. Your Contact Information: Your full legal name, address, telephone number, and email address.
  4. A Statement of Good Faith: The following statement:

"I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."

  1. A Statement of Accuracy: The following statement:

"I swear, under penalty of perjury, that the information in this notification is accurate, and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."

  1. Your Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Please note: Submitting a false claim or knowingly misrepresenting that material is infringing may make you liable for damages, including costs and attorneys' fees, under applicable law.

All Takedown Notices must be sent to our official Designated Copyright Agent:

5. Rightika's Action Upon Receipt

Upon receipt of a valid Takedown Notice that substantially complies with the requirements of Section 3:

  1. We will promptly remove or disable access to the allegedly infringing Content.
  2. We will notify the affected Seller that their Content has been removed.
  3. We will provide the Seller with a copy of the Takedown Notice (with personal contact information redacted as appropriate).

6. Counter-Notification Procedure (For Sellers)

If you are a Seller and you believe your Content was removed by mistake or misidentification, you may submit a Counter-Notification to our Designated Copyright Agent.

To be effective, your Counter-Notification must be a written communication that includes:

  1. Identification of the Removed Material: A description of the Content that was removed and the URL where it was located before its removal.
  2. Your Contact Information: Your full legal name, address, telephone number, and email address.
  3. Statement of Good Faith: The following statement:

"I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled."

  1. Consent to Jurisdiction: The following statement:

"I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located (or if my address is outside Canada or the United States, I consent to jurisdiction of the courts in Toronto, Ontario), and I will accept service of process from the person who provided the original Takedown Notice or their agent."

  1. Your Signature: Your physical or electronic signature.

7. Action on Counter-Notification

Upon receipt of a valid Counter-Notification:

  1. We will promptly forward a copy to the person who submitted the original Takedown Notice (the "Complainant").
  2. We will inform the Complainant that we will restore the removed Content or cease disabling access to it within 10 to 14 business days, unless the Complainant notifies us that they have filed a court action seeking an injunction to restrain the Seller from engaging in the infringing activity.

8. Metadata Removal & Rights Holder Requests

Rightika respects the rights of copyright owners and rights holders.

If you are a producer, distributor, sales agent, copyright owner, or authorized representative and believe that any metadata, poster, artwork, title information, company association, or rights information displayed on the Platform is inaccurate, unauthorized, misleading, or should be removed, you may submit a request to [email protected].

Upon review, Rightika may update, restrict, remove, suppress, or verify the relevant information at its sole discretion.

9. Repeat Infringer Policy

Rightika takes copyright infringement very seriously. In accordance with our legal obligations, we will terminate the accounts of Users who are determined to be "repeat infringers" in appropriate circumstances.
